General terms of sale – Béligneux Le Haras (Amicable sales of gestation and foals)

  1. Identity of the seller
    Béligneux Le Haras SAS or EUROPEAN STALLIONS RESORT earl , whose registered offices are located respectively at 1702 and 1500 chemin des Sauvagères – 01960 SERVAS – France , organize amicable sales of foals or gestations, hereinafter referred to as “the Lot(s)”.

  2. Acceptance of conditions
    Any order or purchase of a Lot from Béligneux Le Haras implies unreserved acceptance of these terms and conditions of sale, which prevail over any other document.

  3. Terms of sale
    Sales are concluded amicably, by direct negotiation between Béligneux Le Haras and the Purchaser. All purchase proposals are binding. The Buyer guarantees that he/she is legally capable of contracting and acquiring an equine or a gestation.

  4. Technical support and communication
    Digital media may be used to present the Lots (photos, videos, technical sheets, etc.). Béligneux Le Haras cannot be held responsible for any unavailability or interruption of online services. The Purchaser undertakes to secure his digital tools to prevent any infringement or piracy during exchanges.

  5. Price and VAT
    The sale is carried out in euros, according to the price amicably agreed between the parties. This price may be stated inclusive or exclusive of VAT, depending on the applicable VAT regime (to be specified on a case-by-case basis). Any VAT is added in accordance with current tax legislation.

  6. Sales fees
    Béligneux Le Haras does not apply any commission fees for amicable sales, unless otherwise stipulated in a specific contract. Any exceptions will be expressly indicated in writing to the Purchaser before the sale is concluded.

  7. Invoicing and payment
    An invoice is issued upon acceptance of the offer. Full payment of the amount due is required prior to any delivery. The transfer of ownership of the Lot occurs only after effective collection of the sums due.

  8. Late payment
    In the event of late payment, penalties will be applied by operation of law at a rate of 1% per month of delay, as well as a fixed indemnity for collection costs of 10% of the amount due.

  9. Transfer of risks and delivery
    The risks relating to the Lot are transferred to the Buyer upon full payment. Delivery of the Lot is by mutual agreement. Transport costs, if any, shall be borne by the Buyer. Unless otherwise agreed, delivery will be made from the Béligneux Le Haras premises.

  10. Insurance
    It is the Buyer’s responsibility to take out, at his own expense, any insurance required (life, death, accident, transport, etc.) upon conclusion of the sale.

  11. Warranty and liability
    Lots are sold as described and presented. Available veterinary documents can be sent on request. Béligneux Le Haras shall not be held responsible for any apparent or hidden defects subsequent to the sale, except in the case of fraud or proven concealment.

  12. Descriptive information
    The information contained in the ads, listings or videos is provided for information purposes only, without any guarantee of performance or results. No claim may be made on the grounds of any inaccuracy or error in the description.

  13. Export
    In the event of export outside France, the Buyer is responsible for declaring and providing the documents required to justify the exemption or deferred application of VAT. In the absence of proof within three months, French VAT will be invoiced and payable.

  14. Safeguard clause
    Should any clause of these terms and conditions be deemed null and void, the other provisions shall remain in full force and effect. A replacement clause will then be preferred, in keeping with the original spirit and purpose.

  15. Applicable language
    Only the French text of these conditions is authentic. Any translation is provided for information purposes only.

  16. Disputes and applicable law
    Any dispute relating to the interpretation or performance of these terms and conditions shall be governed exclusively by French law. In the event of disagreement, the competent courts will be those of Bourg-en-Bresse, unless the parties agree otherwise.
